Should he show that he is hafiz of Qur’aan so as to encourage people?

 

I am hafiz of Qur’aan, praise be to Allaah. Is speaking of that for the purpose of encouraging others permissible? Or is it something that should be kept secret between a person and his Lord? i.e. is it better to conceal it?.

Praise be to Allaah.

It is permissible for a
person to speak of what Allaah has blessed him with of knowledge or hifz
(memorization of Qur’aan) if that is done so as to ward off harm or to serve
the interests of people, such as if he wants to encourage them to memorize
Qur’aan and seek knowledge, and that is not regarded as the kind of
self-praise that is forbidden. Allaah tells us that Yoosuf (peace be upon
him) said (interpretation of the meaning): 

“[Yoosuf (Joseph)] said:
‘Set me over the store‑houses of the land; I will indeed guard them with
full knowledge” (as a minister of finance in Egypt)’”

[Yoosuf 12:55]. 

‘Abd-Allaah ibn Mas’ood
(may Allaah be pleased with him) said: I recited seventy-odd soorahs to the
Messenger of Allaah (peace and blessings of Allaah be upon him) and the
companions of the Messenger of Allaah (peace and blessings of Allaah be
upon him) know that I am the most knowledgeable among them of the Book of
Allaah. If I knew that anyone was more knowledgeable than me, I would go to
him. Narrated by Muslim (4502). 

Al-Nawawi (may Allaah have
mercy on him) said, commenting on this hadeeth: This hadeeth shows that it
is permissible for a person to mention virtues and knowledge that he has if
there is a need for that. 

With regard to the
prohibition on praising oneself, that refers to praising oneself
unnecessarily, when the motive is boasting and self-admiration. But
prominent people often praised themselves when there was a need, such as to
ward off harm thereby or to achieve something that is in the people’s
interests, or to encourage them to acquire knowledge from him, and so on. An
example of serving the people’s interests is when Yoosuf (peace be upon him)
said: “Set me over the store‑houses of the land; I will indeed guard them
with full knowledge”, and an example of warding off harm is when
‘Uthmaan (may Allaah be pleased with him) said, when he was under siege that
he had supplied equipment to the army that went to Tabook, and had dug the
well of Roomah. And an example of encouragement to others is when Ibn
Mas’ood said this (the words quoted above) and when Sahl ibn Sa’d said:
There is no one left who has more knowledge of that than me, and when
someone else said: You have come to the expert, and so on. End quote. 

But whenever a person is
able to conceal his knowledge, that is better, because his showing it and
speaking of it may open the door to the shaytaan and cause him to fall into
pride and self-admiration.

Building more houses than are needed and paying zakaah on them

 

I have read in one hadeeth that if a man builds houses more than what is required then on the day of judgement he will have to carry those houses a burden on his back. I would like to know that if one pays proper zakat of the extra houses then still he has to burden those on his back on the day of judgement.

Praise be to Allaah.
 

 

Firstly: 

We do not know of this hadeeth to which you
refer. The one who it is proven will carry things on his back on the Day of Resurrection is the one who took things unlawfully from others in this
world, whether by force or by stealth, or stealing booty from the battlefield before the spoils of war were distributed. 

It was narrated that Abu Hurayrah (may Allaah
be pleased with him) said: The Prophet (peace and blessings of Allaah be upon him) stood before us and spoke about war booty and how serious
the matter is. He said,

“I should not like to see anyone amongst you
on the Day of Resurrection, carrying on his neck a sheep that will be bleating, or carrying on his neck a horse that will be neighing, saying: ‘O
Messenger of Allaah! Help me!’ and I will reply, ‘I cannot do anything for you, for I have conveyed Allaah's Message to you.’ Nor should I like to
see a man carrying on his neck, a camel that will be grunting, saying: ‘O Messenger of Allaah! Help me!’ and I will reply, ‘I cannot do anything
for you, for I have conveyed Allaah's Message to you.’  Or one carrying on his neck gold and silver, saying: ‘O Messenger of Allaah! Help me!’ and
I will reply, ‘I cannot do anything for you, for I have conveyed Allaah's Message to you.’ or one carrying clothes that will be fluttering,
saying: ‘O Messenger of Allaah! Help me!’ and I will reply, ‘I cannot do anything for you, for I have conveyed Allaah's Message to you.’” 

Narrated by al-Bukhaari, 2908; Muslim, 1831

Secondly: 

With regard to a
Muslim building a house that is bigger than he and his family need, Ibn Hazm said: 

(The scholars) are agreed that it is
obligatory for a man to build that which will shelter him and his family from prying eyes and from cold, heat and rain, or to buy a house or
dwelling that will cover him in the manner mentioned. And they agreed that it is permissible to seek to earn more money and build a more spacious
house so long as that is done by halaal means and he fulfils all his duties towards Allaah, but they differed as to whether that is makrooh or
not.” 

Maraatib al-Ijmaa’,
p. 155 

What the Muslim should
do is not to go to excess in matters of this world, and to limit himself to what he needs, based on the general meaning of the verses which forbid
extravagance, such as the verse in which Allaah says (interpretation of the meaning): 

“And those who, when they spend, are neither
extravagant nor niggardly, but hold a medium (way) between those (extremes)”

[al-Furqaan 25:67] 

Al-Tirmidhi (4283) narrated from Khabbaab
(may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “A person will be rewarded
for all his spending except what he spends on building.” Classed as saheeh by al-Albaani in Saheeh al-Tirmidhi. Also narrated by
al-Bukhaari (5672) from Khabbaab (may Allaah be pleased with him). Ibn Hajar said: This is understood as referring to what exceeds one’s
requirements. 

This is also indicated by the way the Prophet
(peace and blessings of Allaah be upon him) was: he rose above preoccupation with this world, and warned his ummah against indulging in
worldly pleasures, as he said in the hadeeth: “By Allaah, I do not fear poverty for you but I fear prosperity in this world as those who came
before you became prosperous, and you start to compete with one another in worldly gains, as they did, then you will be destroyed as they were.” 

Narrated by al-Bukhaari, 3158; Muslim, 2961. 

Thirdly: 

There is no zakaah due on the houses that a
Muslim builds for his family or children, even if their value rises. And houses that he builds to rent them out are not subject to zakaah
themselves, rather zakaah is due on the rent if it reaches the nisaab and one whole hijri year has passed. Houses that he builds in order to sell
them are subject to zakaah, because they are a kind of trade goods, so after one year has passed he should calculate their value and pay zakaah on
them, one-quarter of one-tenth of the total value.

She gave birth to a child who only had four fingers; how should she deal with this calamity?

 

A son was born to me who has only four fingers on his right hand, and I was not bothered by that, but last night I was looking at a picture of a right hand and how Allah creates the fingers and palm so beautifully, and I burst into tears. It is true that I cannot do much about it, but I do not know why my son is like this, when there is no one else in the family who has this condition; even his older brother is physically complete.


I think these feelings are natural and would be felt by any mother in a situation such as mine. I am very upset by it but I do not show my pain. But sometimes I think how I am going to answer his questions when children make fun of him in school when he is older, and he comes to me and asks me about that. What should I tell him then?.

We understand your feelings towards your child as a mother
and how you feel when you see that Allah has tested your son with what you
mentioned. We will highlight a few points that we hope will be beneficial to
you in dealing with this test and handling it well.

You have to ponder the great wisdom of Allah, may He be
exalted, in what He decrees; the fact that your son was created with only
four fingers is included in what you should ponder. Allah, may He be
exalted, has not created anything in vain; rather He has created it for
sublime reasons and great wisdom. For example, He has decreed that some of
His creation should be affected by physical defects in which they vary. One
of the greatest wisdoms behind that is that this is a test for his parents,
and for the son when he grows up and become an adult who is accountable. We
have discussed this in detail in the answer to question no.
13610.

We hope that you will not be distracted by painful memories,
because focusing too much on feelings of sorrow and pain will lead to
neglecting your duties and not striving in the child’s best interests. It
may also lead you -- Allah forbid -- to get angry and object to what Allah,
may He be exalted, has done.

We do not think that the fact that Allah created your son
with four fingers is a serious test. Allah has made his mind sound and has
made him able to move, and he can eat, sleep, see and hear. These are great
blessings for which you need to be grateful.

We advise you to take care of your son and teach him skills
in which he may be able to surpass his peers, to make up for the defect in
his body. For example, you could teach him to memorize Qur’aan or seek
knowledge, which will make him a distinctive child who is praised, so he
will not feel that he is less than his peers.

Avoid dealing with him on the basis of pure emotions; do not
let him see that you are upset or sad, so that he will not feel that he is
less than his siblings or peers.

Tell his brothers and sisters that they have to be careful in
the way they speak to him and not make fun of him, and there should be
strict punishment for anyone who goes against that.

Work with the school administration and social services so
that he will be taken care of and looked after, anyone making fun of him
will be punished and he will be helped to overcome the effects of that if it
happens.

Try to make your son one of those who frequent the mosques,
so that he will have good friends who are seekers of knowledge and those who
have memorized the Qur’aan. These are the people who -- in sha Allah -- will
not make fun of him. 

When he grows up, teach him that Allah, may He be exalted,
has tested other people with things that are more severe than what he has
been tested with. There are some who cannot move, and some who are insane,
or blind, or deaf, or who have leukaemia, or who have to have kidney
dialysis every two days, and so on. There are many severe calamities that
Allah has spared him from. He should understand that what Allah has tested
him with is nothing in comparison to other severe calamities. Over and above
all that, he should understand that he has been given the greatest blessing,
namely Islam; Allah has made him one of those who proclaim the Oneness of
Allah, which is an immense blessing for which he should give thanks with his
heart, his tongue and all his physical faculties. And he should understand
that this world is the place of tests, trials, sorrow, pain and
imperfection, and that happiness, joy and perfection will come in the
Paradise of eternity, so let him strive to be one of its people. 

We ask Allah, may He be exalted, to help you and make things
easy for you, and we ask Him, may He be exalted, to guide him to that which
leads to His pleasure.

Rulings on images on the television

 

Some of those who call people to Allah still have some reservations about images on televisions, hence they do not take part in TV programmes. What is your opinion on that?.

Praise be to Allaah.

Yes, there are undoubtedly people who have reservations
about that, namely using images produced by cameras for the purpose of
broadcasting on television and they have reservations about spreading
knowledge via television. That varies according to what Allah has given to
people of knowledge, understanding and insight, and examining end results.
Those who have knowledge and feel at ease working in television and
conveying the message of Allah, will have their reward with Allah. Those
who are confused about the matter and whose hearts are not at ease with
that, we hope that they will be blamed. 

Personally, I believe that the one whose heart Allah puts at
ease concerning this issue and whom Allah helps to do that, this serves a
great interest -- which is spreading religion and guiding people to good --
and the harm resulting from the images produced for that purpose it is a
minor harm which is insignificant when compared with the great interest that
is achieved, namely conveying the message of Allah to the people, teaching
the people the laws of Allah and guiding people to good, so that that the
followers of falsehood will not have this field to themselves and will have
all these facilities to themselves to spread their call to falsehood. We ask
Allah to keep us safe and sound. End quote. 

Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allah have mercy on him) 

Now days we as Muslims have to spread the voice to learn quran and so we could gain the true knowledge and the quran teaching that is give to us by our beloved prophet Muhammad peace be upon him and do quran reading. Ruling on drawing the face of the patient before doing cosmetic surgery on him

 

My question is with regards to the drawing of inanimate objects. I work as a doctor, and often we see patients with injuries/deficits etc on the face and therefore have to draw the face with features in the medical records to highlight these injuries etc.


I had read that it is forbidden to draw the face/facial features. In the case of medical records, to document injuries and so forth, would this be permissible Islamically? I cannot undo what I have now done, and am worried about the consequences of my actions.

Praise be to Allaah.

It is
not permissible to draw or photograph animate beings such as humans, birds
or animals. This has been discussed previously in the answer to question
no. 8954. 

An
exception is made from that in cases of necessity, such as photographs for
passports or ID cards, or photographs of criminals and the like. 

That
also includes what you have mentioned of drawing or photographing the face
and whatever deformities or injuries are in it before doing surgery, and
keeping the picture in the medical records. This is a case of necessity, in
addition to the fact that the picture is incomplete. But in that case it
should be limited to a photograph and should not be drawn, because drawing
is more haraam than photography; the majority of fuqaha’ are of the view
that it is forbidden to draw animate beings, whereas in the case of
photography, there is a well-known difference of opinion among contemporary
scholars concerning it. 

Shaykh
Muhammad ibn Ibraaheem Aal al-Shaykh (may Allah have mercy on him) said: 

If the
picture is incomplete, such as a picture of the face or head or chest, and
so on, and something is removed from the picture that represents a part of
the body without which there can be no life, then the words of many fuqaha’
indicate that it is permissible, especially if there is a need for that,
which is partial depiction. Whatever the case, people should fear Allah as
much as they are able to and should avoid that which Allah and His Messenger
have forbidden.

“And
whosoever fears Allaah and keeps his duty to Him, He will make a way for him
to get out (from every difficulty).

3. And He will provide him from (sources) he never could imagine”

[al-Talaaq
65:2-3]

Do the recording angels enter houses in which there are images?

 

The two Angels, where write our live of a book (good and bad things) arent come to the house with picture? When i pray and there is a picture. I must give Salaam to the angels(Taslim) and the angels aren't here, because there are pictures in the house?.

Praise be to Allaah.

Yes, the recording angels who write down the deeds of the
son of Adam enter houses in which there are images. What is meant by the
angels who do not enter a house in which there are images are the angels
of mercy. 

Al-Bukhaari (3226) and Muslim (2106) narrated from Abu Talhah
(may Allah be pleased with him) that the Prophet (blessings and peace of
Allah be upon him) said; “The angels do not enter a house in which there is
an image.” 

Al-Nawawi (may Allah have mercy on him) said: 

The scholars said: The reason why they do not enter a house
in which there is an image is because it is a grievous sin, and it is
competing with the creation of Allah, may He be exalted, and some of them
are images of things that are worshipped instead of Allah, may He be
exalted. 

With regard to these angels who do not enter a house in which
there is a dog or an image, they are the angels who go round with mercy,
blessings and prayers for forgiveness. With regard to the recording angels,
they enter every house and never leave the sons of Adam under any
circumstances, because they are enjoined to list and record their deeds. End
quote. 

Sharh Muslim, 14/84 

It says in Tuhfat al-Ahwadhi (8/72):  

The words “the angels do not enter” mean: the angels of
mercy, not the recording angels or the Angels of death. End quote. 

Ibn al-Atheer (may Allah have mercy on him) said: 

What is meant is the angels who travel about and not the
recording angels and those who are present at the time of death. End quote. 

Al-Nihaayah, 4/789. 

Al-Suyooti (may Allah have mercy on him) said: 

Al-Khattaabi said: What is meant is the angels who bring
mercy and blessings, not the recording angels. End quote. 

Sharh al-Nasaa’i, 1/141 

Shaykh Muhammad ibn Ibraaheem (may Allah have mercy on him)
was asked: Are his words “The angels do not enter a house in which there is
an image or a dog” general in meaning and do they include the recording
angels or not? 

He replied: It seems that they are not included in this. End
quote. 

Fataawa wa Rasaa’il Muhammad ibn Ibraaheem,
1/169 

The images which prevent the angels from entering a house are
images of animate beings, apart from images that are deal with in a
disrespectful manner. 

Al-Khattaabi (may Allah have mercy on him) said: The angels
do not enter a house in which there is a dog or an image that it is
forbidden to keep. With regard to that which it is not forbidden to keep,
such as a dog for hunting, farming or guarding livestock, or images that are
not dealt with in a respectful manner (such as) those on carpets, pillows
and the like, the angels are not prevented from entering because of them.
End quote.

 Tuhfat al-Ahwadhi,
8/72 

Shaykh Ibn ‘Uthaymeen said: If the images are treated without
respect, such as images on carpets or pillows, the majority of scholars are
of the view that they are permissible. Based on that, the angels are not
prevented from entering that place, because if they were prevented that
would be not allowed. End quote. 

Liqa’ al-Baab al-Maftooh, 85/6 

With regard to praying in a place where there is an image, it
is not permissible, unless the Muslim is forced to pray in that place and is
not able to remove the image. 

The scholars of the Standing Committee for Issuing Fatwas
said: 

Praying in places where these images are is not permissible
except in cases of necessity. The same applies to praying in clothes on
which there are images of animals; it is not permissible, but if he does it,
his prayer is sound but he is committing a haraam action. End quote.

Is it haraam to buy pictures of male and female singers?

 

Is it haraam to buy pictures of male and female singers in which the head, shoulders and hair only appear? Please note that the female singer is uncovering her hair and there are no pictures of her in which her hair is covered, and this is only because of love of the artist, or because she is one’s favourite artist.

Praise be to Allaah.

The basic principle with regard to pictures of animate
beings is that they are haraam, whether they are three-dimensional
(statues) or two-dimensional, such as pictures in frames, on clothing, or
otherwise. 

This has been discussed in the answer to question number no.
10668. In the answer to
question no. 143709, there is
a discussion of the ruling on buying clothing on which there are pictures. 

This prohibition has to do with the issue of making images,
regardless of whether there is anything in the picture itself that is
contrary to sharee‘ah in the first place. Pictures of scholars, men,
children or animals all come under this ruling; it is the picture itself
which is contrary to sharee‘ah. 

But if in addition to that the picture includes something
that is contrary to sharee‘ah, such as if it is a picture of a naked woman
or one who is showing part of her body, even if it is the face and hands,
then it is more haraam and a greater sin, because it includes another thing
that goes against sharee‘ah in addition to image-making. 

So how about if the picture is of those who promote evil and
spread immorality, such as actors, singers and the like, whose images are
traded in shops that promote evil and vice, to make sick hearts even more
attached to them? The one who knows the ruling on image-making will have no
doubt that they are haraam. Moreover, it is known what effect these pictures
have of filling the heart with infatuation and corrupting it. This is what
the questioner is expressing when he says “this is only because of love of
the artist”. What more do you want after that, O slave of Allah?! 

The Messenger of Allah (blessings and peace of Allah be upon
him) said: “The angels do not enter a house in which there is a dog or an
image.” Narrated by al-Bukhaari (3075) and Muslim (3930).

Once it is understood that it is haraam to keep these images,
we know that whatever Allah has forbidden, buying and selling it is also
haraam, and spending money on it is a waste of money and is a kind of
extravagance that is haraam. The Messenger of Allah (blessings and peace of
Allah be upon him) said: “May Allah curse the Jews. Animal fat was forbidden
to them, so they sold it and consumed its price. When Allah, may He be
glorified and exalted, forbids eating something, He also forbids its price.”
Narrated by Ahmad, 2546.

He lived in sin with his girlfriend and had a child from her and he wants to marry her

 

I live in the west and during the last three years I got to know a kitaabi girl (from the people of the Book – Jewish or Christian), and the relationship between us deepened. That was with the approval of her family and mine. After that we had a daughter and we applied for a civil marriage, but the court refused to marry us because the girl has not yet reached the age where marriage is allowed in that country. I had no choice but to go to the imam of our mosque and the girl’s guardian, and two witnesses of good character came, and we got married in this manner. Is the marriage legitimate according to sharee’ah? Do I have to do anything because of the previous years that I spent with this kitaabi girl without being married? Please advise me, may Allaah reward you with good.

Praise be to Allaah.

Firstly: 

Undoubtedly
you did something very wrong for yourself and your religious commitment when
you agreed to form a haraam relationship with a Christian woman. As for
yourself, that is by committing the sin of zina for which Allaah warns of a
severe punishment and decrees the hadd punishment in this world: one hundred
lashes for one who is not married and stoning to death for one who is
married. As for your religious commitment, that is by giving a bad example
of Islam and its morals and rulings to those kuffaar, whether in the land
where you live or the family of the woman with whom you are living. How can
they respect Islam and the Muslims when they do not see any difference
between you and others of the people of the Book? 

What you –and
your family who knew of your sin – must do is repent sincerely from this
great sin. You should realize that you did not only fall into the sin of
zina which Islam warns against even approaching, but you persisted in that
and lived with the woman as man and wife. This makes your sin worse than the
sin of others who may fall into the sin of immorality without continuing or
persisting in it. 

Allaah says
(interpretation of the meaning): 

“And those who
invoke not any other ilaah (god) along with Allaah, nor kill such person as
Allaah has forbidden, except for just cause, nor commit illegal sexual
intercourse
__and whoever
does this shall receive the punishment.

69. The
torment will be doubled to him on the Day of Resurrection, and he will abide
therein in disgrace;

70. Except
those who repent and believe (in Islamic Monotheism), and do righteous
deeds; for those, Allaah will change their sins into good deeds, and Allaah
is Oft‑Forgiving, Most Merciful”

[al-Furqaan
25:68-70]

Secondly: 

It should be
noted that it is not permissible for you to marry this kitaabi woman unless
you repent sincerely to Allaah, and until you are certain that she will not
commit immoral actions with anyone and that she will not have boyfriends.
This is one of the conditions of marriage to a kitaabi woman. 

Allaah says
(interpretation of the meaning): 

“The food
(slaughtered cattle, eatable animals) of the people of the Scripture (Jews
and Christians) is lawful to you and yours is lawful to them. (Lawful to you
in marriage) are chaste women from the believers and chaste women from those
who were given the Scripture (Jews and Christians) before your time when you
have given their due Mahr (bridal-money given by the husband to his wife at
the time of marriage), desiring chastity (i.e. taking them in legal wedlock)
not committing illegal sexual intercourse, nor taking them as girlfriends”

 

[al-Maa'idah 5:5] 

What you
should have done was to tell the one who did the marriage contract for you
about your situation and hers, so that he could have enjoined you to repent
and told you of the conditions of her being chaste and avoiding zina, and so
that you could wait for one menstrual cycle until it was established that
she was not pregnant, or until she gave birth if she was pregnant. 

Ibn Qudaamah
(may Allaah have mercy on him) said: 

If a woman
commits zina, it is not permissible for the one who knows of that to marry
her unless two conditions are met: 

1-   

That
her ‘iddah has ended. If she is pregnant as the result of zina then her
‘iddah ends when she gives birth, and it is not permissible to marry her
before she gives birth.

2-   

That
she repents from committing zina. 

And he said:
If both conditions are met, it is permissible for the zaani (the man who
committed zina) or anyone else to marry her according to the majority of
scholars, including Abu Bakr, ‘Umar and his son, Ibn ‘Abbaas, Jaabir, Sa’eed
ibn al-Musayyab, Jaabir ibn Zayd, ‘Ata’, al-Hasan, ‘Ikrimah, al-Zuhri,
al-Thawri, al-Shaafa’i, Ibn al-Mundhir and ashaab al-ra’y. 

Al-Mughni
(7/108, 109)

 Shaykh
Muhammad ibn Ibraaheem (may Allaah have mercy on him) said:  

It is not
permissible to marry a woman who has committed zina until she repents. If a
man wants to marry her then he must wait for one menstrual cycle to
establish that she is not pregnant before doing the marriage contract with
her. If it turns out that she is pregnant, it is not permissible for him to
do the marriage contract with her until after she gives birth. 

Al-Fataawa
al-Jaami’ah li’l-Mar’ah al-Muslimah
(2/584) 

You do not
have the right to do the marriage contract in the courts that govern by
man-made laws, or in their churches, rather what you did by asking the imam
of the mosque to do the marriage contract was the right thing to do. There
is nothing wrong with confirming it in the courts for official purposes. 

The scholars
of the Standing Committee said: 

If the
proposal and acceptance are completed, along with all the other conditions
of marriage, and it is free from any impediments, then it is valid. If
confirming it legally (in the civil court) could serve some shar’i interests
of both parties, both now or in the future, then that must be done. 

Fataawa
al-Lajnah al-Daa’imah
(18/87). 

And they
said: 

If the
marriage contract is not recognized and no rights will be granted unless it
is confirmed in a non-shar’i court, then this does not affect the validity
of the marriage, but there is nothing wrong with confirming it in a
non-shar’i court if the aim is to record it for official purposes. 

Fataawa
al-Lajnah al-Daa’imah
(18/87). 

Thirdly: 

As for your
daughter, she is the product of an illegitimate relationship and it is not
permissible for her to be named after you, rather she should be named after
her mother. 

It was
narrated from ‘Amr ibn Shu’ayb from his father that his grandfather said:
The Prophet (peace and blessings of Allaah be upon him) ruled that
whoever was born to a slave woman whom his father did not own or to a free
woman with whom he committed adultery, then he cannot be named after him and
he does not inherit from him, even if the one whom he claims is his father
acknowledges him. So he is the product of zina, whether his mother was a
free woman or a slave. 

Narrated by
Abu Dawood (2265) and Ibn Maajah (2746); classed as hasan by al-Albaani in
Saheeh Abi Dawood. 

The scholars
of the Standing Committee said, concerning a similar case: 

The daughter
mentioned, who is the result of illicit relations with her mother, is not
your daughter according to sharee’ah, and it is not permissible for her to
be named after you, because she was born from haraam water, which is zina.
So she should be named after her mother and not after the one who committed
zina with her.

al-Lajnah al-Daa’imah
(18/321, 322)                             

If it is not
possible to name the child after the mother in the land where the mother
lives, she may be given a name which does not belong to anyone in
particular, so she may be given a name to use in official papers and
documents.

remind you that it is haraam to settle in a kaafir land, and you should
learn a lesson from what happened to you and try to leave that land and
settle in a Muslim country where you will see Islam being practised openly
and you will be able to raise your children to follow Islam, be chaste and
have good attitudes.

He committed zina during one of the nights of Ramadan and he wants to repent

 

One of my friends had sex with a girl during one of the nights of Ramadaan. He is single and is asking about the ruling and what he has to do.

Praise be to Allaah.

If what is meant is that he committed zina –Allaah forbid –
then zina is a major sin and a serious offence. Allaah has warned us against
it and stated that it leads to bad consequences. He says (interpretation of
the meaning): 

“And come not near to unlawful sex. Verily, it is a
Faahishah (i.e. anything that transgresses its limits: a great sin), and an
evil way that leads one to hell unless Allaah forgives him)”

[al-Isra’ 17:32] 

Allaah has decreed that the punishment for the zaani is
stoning, if he was married, and flogging if he was unmarried. That is
because of the abhorrence of what he has engaged in of haraam intimacy.
Allaah says (interpretation of the meaning): 

“The fornicatress and the fornicator, flog each of them
with a hundred stripes. Let not pity withhold you in their case, in a
punishment prescribed by Allaah, if you believe in Allaah and the Last Day.
And let a party of the believers witness their punishment”

[al-Noor 24:2] 

But by the mercy of Allaah, the door of repentance is always
open, and Allaah is Oft-Forgiving, Most-Merciful; He loves the repentance of
His slaves and accepts it if he turns to Him. Allaah says (interpretation of
the meaning): 

“Know they not that Allaah accepts repentance from His
slaves and takes the Sadaqât (alms, charity), and that Allaah Alone is the
One Who forgives and accepts repentance, Most Merciful?”

[al-Tawbah 9:104] 

“Allaah accepts only the repentance of those who do evil
in ignorance and foolishness and repent soon afterwards; it is they whom
Allaah will forgive and Allaah is Ever All‑Knower, All‑Wise”

[al-Nisa’ 4:17] 

“And those who invoke not any other ilaah (god) along with
Allaah, nor kill such person as Allaah has forbidden, except for just cause,
nor commit illegal sexual intercourse __
and whoever does this shall receive the punishment.

69. The torment will be doubled to him on the Day of

How forbearing is Allaah, and how Generous. His goodness
descends upon them even as their evil deeds ascend to Him. He holds out His
Hand by night to accept the repentance of the one who sinned during the day,
and He holds out His hand during the day to accept the repentance of the one
who sinned at night. All the sinner has to do is acknowledge his sin and
give it up, and ask his Lord for pardon and forgiveness, and resolve never
to go back to that sin, and to set his deeds straight, and strive to do that
which will please his Lord, may He be blessed and exalted. 

The one who does that will find relief, for the Most
Gracious, Most Merciful rejoices over the repentance of His slave and
accepts it from him, and He will reward him for it and erase his bad deeds
thereby, and raise him in status, because He is the Forbearing, Most
Generous, Most Kind, Most Merciful, may He be blessed and exalted. 

Allaah says (interpretation of the meaning): 

“And verily, I am indeed forgiving to him who repents,
believes (in My Oneness, and associates none in worship with
Me) and does righteous good deeds, and then remains
constant in doing them (till his death)”

[Ta-Ha 20:82] 

Moreover, we say to this brother: beware of removing the
cover with which Allaah has concealed you and telling anyone of what you
have done, because the Prophet (peace and blessings of Allaah be upon
him) said: “Avoid these filthy things that Allaah has forbidden. Whoever has
done any of them, let him conceal himself with the concealment of Allaah,
and let him repent to Allaah.” Narrated by al-Bayhaqi; classed as saheeh by
al-Albaani in Saheeh al-Jaami’ (149). 

Muslim (2590) narrated from Abu Hurayrah (may Allaah be
pleased with him) that the Prophet (peace and blessings of Allaah be
upon him) said: “Allaah does not conceal a person in this world but Allaah
will conceal him on the Day of Resurrection.” 

So hasten to repent and regret, and weep for your sin and
wrongdoing. Conceal yourself with the concealment of Allaah and do not speak
openly of your sin;  do a lot of good deeds such as praying, giving charity,
dhikr, and tasbeeh, for these are means of attaining forgiveness. 

Beware of procrastinating with regard to repentance, or of
taking the forbearance and concealment of Allaah for granted, for Allaah may
grant you time or He may not, and He may become angry and seek vengeance.
Perhaps He will look at His slave who dares to disobey Him and will say:
‘Go, for I will never accept any good deed from you,’ so he will be utterly
lost and his punishment will be Hell. We ask Allaah to keep us safe and
sound and to grant us salvation. 

We ask Allaah to set the affairs of the Muslims straight, and
to bring that back to the right path.

Ruling on one who commtted zina with a non-Muslim woman when he was not married

 

What is the ruling on committing zina with a non-Muslim woman when one is not married?.

Praise be to Allaah.

Firstly: 

Zina is a major sin and one
of the worst crimes. Allaah says (interpretation of the meaning): 

“And come not near to
unlawful sex. Verily, it is a Faahishah (i.e. anything that transgresses its
limits: a great sin, and an evil way that leads one to hell unless Allaah
Forgives him)”

[al-Isra’ 17:32] 

“And those who invoke
not any other ilaah (god) along with Allaah, nor kill such person as Allaah
has forbidden, except for just cause, nor commit illegal sexual intercourse
__and whoever does this shall receive the punishment.

69. The torment will be
doubled to him on the Day of Resurrection, and he will abide therein in
disgrace”

[al-Furqaan 25:68-69] 

It makes no difference
whether zina is committed with a Muslim woman or a non-Muslim. 

Secondly: 

As for the punishment for
zina in this world, Allaah has enjoined the hadd punishment for it. Allaah
says concerning the hadd punishment of an unmarried zaani (i.e., one who has
not been previously married) (interpretation of the meaning): 

“The fornicatress and
the fornicator, flog each of them with a hundred stripes. Let not pity
withhold you in their case, in a punishment prescribed by Allaah, if you
believe in Allaah and the Last Day. And let a party of the believers witness
their punishment”

[al-Noor 24:2]. 

As for the one who has
previously been married, the punishment is to be stoned to death, as it says
in the hadeeth narrated by Muslim in his Saheeh (3199) from the
Prophet (peace and blessings of Allaah be upon him), who said: “For a
previously married person with a previously married person, one hundred
lashes and stoning.” 

In this case too, it makes
no difference whether zina is committed with a Muslim woman or a
non-Muslim. 

The seriousness of this
crime is not limited only to immediate punishment in this world, but the
punishment in the Hereafter is harsher and more severe. It says in the
hadeeth narrated by al-Bukhaari (7074) from Samurah ibn Jundub (may Allaah
be pleased with him) that the Prophet (peace and blessings of Allaah be
upon him) said:  “Last night two persons came to me and woke me up, and set
off with me. … We went on and we came to something like a tannoor oven, in
which there were shouting and voices. We looked inside and we saw naked men
and women, towards whom flames were coming from the bottom of the oven. When
the flames reached them they made a noise. I said to them [the two angels],
‘Who are these people?’ … They said to me, ‘We will tell you… the naked men
and women in the structure like a tannoor oven are the adulterers and
adulteresses.”  

What the one who has fallen
into this major sin must do is repent sincerely to Allaah, and keep away
from everything that may lead to this haraam or cause him to return to it.
Allaah rejoices over the repentance of sinners and accepts it from them.
Allaah says (interpretation of the meaning):  

“Say: O ‘Ibaadi (My slaves) who have transgressed against
themselves (by committing evil deeds and sins)! Despair not of the Mercy of
Allaah, verily, Allaah forgives all sins. Truly, He is Oft‑Forgiving, Most
Merciful”

[al-Zumar 39:53]

Ibn Katheer (may Allaah
have mercy on him) said: This verse is a call to all sinners, kaafirs and
others, to repent and turn to Allaah. It tells us that Allaah forgives all
sins for the one who repents to Him and turns away from them, no matter what
they are, even if they are many and are like the foam of the sea. End quote
from Tafseer Ibn Katheer (7/106)

Can a mother through breastfeeding inherit?

 

Can a woman who is a mother through breastfeeding (radaa’ah) inherit from her son through breastfeeding if he dies and has a wife and children, and how much does she inherit?.

Praise be to Allaah.
 

 

A mother through breastfeeding is not
entitled to inherit from the child whom she breastfed just because she breastfed him, whether he has heirs or not. 

She may be entitled to inherit for some other reason (other than breastfeeding), such as if
she is the grandmother of the infant, or a sister through ties of blood. In that case she is entitled to inherit because of being closely
related. 

And Allaah is the Source of strength.
